It was hard to be "weird" on Hollywood Boulevard around 40 years ago. Amid the sleaze, the drugs, the street musicians, singers and performance artists, and the endless gaudy parade of hookers, pimps, panhandlers and drug-driven crazies that ornamented the area back in the 1970s, you really had to work at being weird.
As difficult as that was, however, two elderly Jewish guys rose to the challenge and succeeded.
In the middle of all the action, they owned a small shop that sold place mats - washable, plastic place mats to put on the dining table before you set down the plate containing your corned beef sandwich, potato salad, half-sour pickles, and glass of Diet Coke.
These were not just any place mats, however. They were "international" place mats, each one decorated with words, phrases and sentences in a foreign language.
The old gentlemen claimed to have place mats in "dozens and dozens" of foreign languages, and signs around the shop promised customers the opportunity to "learn a foreign language while you eat."
Visions of this quirky place and those wonderful old guys sprang back from the depths of memory recently on a visit to ".WORLD," a new mixed-media art exhibition at the Ermanno Tedeschi Gallery in Tel Aviv.
Showcasing the works of artists from Israel, Italy, Hungary, South Korea and the United States, the exhibition aims to bring people together through art.
Says Jenny Hannuna, co-owner of the gallery and one of the organizers of the exhibition, "We are bringing 14 artists from all over the world to have a dialogue on what it is to be internationally minded, and also on the collapse of cultural and linguistic borders."
Hence the name ".WORLD." The dot before the word signifies an Internet address, suggesting, it would seem, that the address of each artist is the whole world, and not merely the country in which he or she lives.
Co-owner Ermanno Tedeschi is even more to the point. He says, "The title of the exhibition is '.WORLD,' and the meaning is to bring all people together. We think that art can do this... that art is the best ambassador for peace in the world. For example, in this exhibit you will see the works of Barbara Nahmad, an Italian painter. She did a painting of [David] Ben-Gurion, and another of [Anwar] Sadat."
With all due respect, however, to the organizers of this exhibition and their good intentions, most of us know that paintings of Ben-Gurion and Sadat are no more apt to bring people together and unite them in peace than an "international place mat" is likely to teach you Italian or French. We can appreciate art without expecting it to work miracles.
Fortunately, there is a lot in this exhibition to appreciate. Nahmad's paintings, with obvious references to the work of Andy Warhol, are visually striking and immediately hit the viewer with full force. At the same time, they invite closer inspection and seem to offer insights into the personalities of each of these iconic figures that we may not have noticed before. Maurizio Savini presents us with the image of a little girl - sculpted from chewing gum, no less - that holds a rolled-up map of the world and gazes thoughtfully at the viewer. The title of this work is "Do We Have to Atone for Everything?" - a question apparently being posed by the little girl.
David Kassman's triptych Melted City fascinatingly depicts a midtown Manhattan that appears to be decomposing in the night; and Riccardo Gusmaroli's World presents the Earth's continents in the midst of whirlpools of movement - movement of water, wind and paper boats full of people and ideas.
There is the very simple, like Valerio Berruti's simply sketched I Wish I Was Special, and the highly complex, like Tobia Rava's Code RaMHal, which presents us with an intricate optical illusion of an inner courtyard - replete with pale sunlight and shadows - constructed entirely of kabbalistic numerology and combinations of Hebrew letters.
ABSTRACT ART is well represented in works by Robert Sagerman and Minjung Kim, and there are compelling works of sculpture by Alex Pinna, especially one called Alias, portraying a faceless, nameless citizen of the world relaxing comfortably in what appears to be some sort of gilded cage. The viewer is left to wonder whether he is living in the cage under duress, or willingly.
Other works in the exhibition pose equally interesting questions. The viewer will have to ponder them on his own, however, as the exhibition catalog seems to have been written more to showcase the curator's erudition than to discuss the actual art work.
".WORLD" is the inaugural exhibition of the Ermanno Tedeschi Gallery, which opened on June 6, along with the exhibition. The new gallery, perched at the edge of Neveh Tzedek in Tel Aviv, is the first overseas venture of a group of galleries, all in Italy.
"I founded my first gallery in Turin in 2004, and then Milan and then Rome," Tedeschi recalls. And then, with my partners Jenny Hannuna and Joseph Matalon, we decided to open a gallery abroad. We decided to open it in Israel.
"Israel is very important to us. I worked here for many years with Israeli artists, and also with the Tel Aviv Museum. There is a very big artistic energy in Tel Aviv and in Israel."
Hannuna is every bit as enthusiastic:
"Tel Aviv has a very strong cultural and artistic vibrancy, a new awakening. And I think that if we bring Italian art to dialogue with Israeli art, it will be a very good marriage. Also, I like this place, Neveh Tzedek.
"For me, it was very important for our gallery to be here. Neveh Tzedek is full of art history, and this history goes right up to contemporary art. I think the life here is just so exciting, and we want to be a part of it."
If you throw a brick up in the air anywhere in Neveh Tzedek or the adjacent neighborhoods of Jaffa, you can be reasonably certain that it will come down on an art gallery, or art museum, or artist's studio - or, at the very least, an artist. The area is, quite simply, a gallery ghetto.
Why, then, do we need another gallery there, owned and operated by people from Rome and Turin?
Tedeschi says, "We are not Israelis opening a gallery. We are coming from abroad to open a gallery and bring something new.
"The Israeli public wants to see something new, something different. I want also to showcase some Israeli artists that the Israeli public does not know."
Tedeschi also believes that in addition to exposing Israelis to new art, he and his gallery are in a position to bring Israeli artists out into the world.
His real raison d'etre, he says, is to educate people about art, both in Israel and abroad.
"I want to tell you something," he says as he sips his espresso. "Since I began my work in galleries, I have chosen artists that I like, not simply artists who are trendy.
"I choose the artists whose works I like, and then I work with them to put on exhibitions in galleries and in museums.
"We want to help young artists become important artists. We also want to help young people become good art collectors, and to create a new generation of better informed collectors. We want to educate people.
"We do not open a new gallery just to sell paintings, but also to teach people that art is important for their lives, for the culture, and to bring people to art. That is my mission."
.WORLD is showing until August 30 at the Ermanno Tedeschi Gallery, Rehov Lilienblum 3, Tel Aviv. Monday-Thursday 11 a.m.-7 p.m.; Friday 11 a.m.-2 p.m.; closed Saturday and Sunday. For more information call (03) 517-0344 or visit www.etgallery.co.il(c) Copyright Jerusalem Post. All rights reserved.

Mr Barnett said WA's nation-leading economic growth figures were "distorted".
The Australian Bureau of Statistics released figures on Wednesday showing the WA economy
grew 8.4 per cent in the September quarter - its fastest pace on record.
"It would be wrong to read too much into those (figures)," Mr Barnett said.
"Those figures are driven to higher levels by investment, particular investment in
the Gorgon (natural gas) project.
"You've basically got a skewing of the figures."

FED:Illegal food imports intercepted
CANBERRA, April 4 AAP - A bunch of retailers have been caught out selling Korean food
products that do not meet Australian food safety standards.
But prosecution has been reserved for the importers, who quarantine officials say had
been regularly bringing in the food items outside importation rules.
The investigation kick-started after the Australian Quarantine and Inspection Service
(AQIS) intercepted one shipment of illegally imported Korean food.
They then managed to track down more importers, and then their retail clients.
All the stores were visited and the non-compliant food seized and destroyed.
The importers will be prosecuted, AQIS's Tim Chapman said in a statement on Monday.
He stressed the importance of adhering to Australia's importation and food safety laws,
saying problem foods can easily bring in exotic pests or diseases.
He urged importers and retailers to make themselves aware of the rules.

Fed: Fox and Kelty back on the jobs trail
MELBOURNE, April 5 AAP - Trucking tycoon Lindsay Fox and former union boss Bill Kelty
will work with the federal government to advise disadvantaged communities on ways to keep
locals in jobs.
Mr Fox and Mr Kelty have been appointed to work with local employment coordinators
in seven regions across Australia as part of a $650 million jobs fund announced by Prime
Minister Kevin Rudd on Sunday.
The initiative follows a similar one in the early 1990s involving Mr Fox and Mr Kelty,
who travelled the country to try to create up to 60,000 jobs.
Mr Fox will repeat the journey with Mr Kelty, Mr Rudd said.
"I want Lindsay to be able to advise employers in disadvantaged communities on practical
ways they can keep their workers and even take on new apprentices and employees," Mr Rudd
said.
"But beyond Lindsay and Bill, I am also today making a broader call to the nation,
that is in these high unemployment areas, for all men and women of good will to rally
around our local employment coordinators and the consultation structures they create with
local government and the wider local community ..." he said.
Australia was not immune to the ebbs and flows of the global economy, Mr Rudd said.
"In the midst of all the complex economic jargon, all the political debates and all
the media commentary, where the rubber hits the road is in one basic thing - jobs."

Mr Rudd said the level of risk for Australian forces was the "great hypothetical question".
"The nation needs to steel itself for higher casualties than we have had so far and
that's a reflection on heightened Taliban activity," he said.
"The Taliban continue to be assisted by I think ineffective strategies to deal with
the opium crop and the flow of revenue which occurs between the opium crop and Taliban
and through the al-Qaeda forces.
"That's why an integrated strategy dealing with military and civilian affairs is critical
if we are to have a prospect of success."

Qld: Brisbane set for coolest Christmas since 1999
BRISBANE, Dec 24 AAP - Weather forecasters have predicted Brisbane's coolest Christmas
Day since 1999.
A top of 27 degrees is expected tomorrow, with a few light showers.
The average Christmas Day temperature is 29 degrees.
Bureau of Meteorology senior forecaster Bryan Rolestone said a cool air mass and high
level cloud would keep the city's temperatures below average this week.
"There will be showers through to the end of the week, just showers, nothing big,"
Mr Rolestone told AAP.
Meanwhile, rain will continue to fall in parched centres west of Brisbane this week.
Mr Rolestone said the Longreach, Emerald, Charleville and Roma areas could expect storms
and showers.
"By Thursday, most of the interior will see thunderstorms and showers," he said.
Despite recent falls, Brisbane is on track for one of its driest years on record.
So far this year, Brisbane has received only 633mm of rain, compared to the normal
annual rainfall of 1,146mm.
It is the lowest annual figure since 2000, but nowhere near the lowest - 411mm in 1902
- during the infamous 26-year federation drought.
August was the only month with above average rainfall, and Mr Rolestone said while
showers were becoming more frequent, they were usually light.
He said it would take a tropical cyclone to cross the coast in a random event, or "exceptional"
falls for a month, before meteorologists could confidently declare the drought broken.
"We are not totally out of the drought yet," he said.
"This drought is very similar to the federation drought that went on for almost 26 years.
"This is only gone on for seven years, so we still could have suppressed rainfall for
a few years yet.
"Rainfall is creeping up, but only gradually."

The Australian Greens have accused the government of fostering an arms race in our

JOHN HOWARD announced an in-principle agreement to export uranium to India last night

Fed: Indigenous adviser quits over Howard govt failings
SYDNEY, Dec 1 AAP - One of John Howard's hand-picked indigenous council members has
quit, accusing the government of reverting to failed policies on indigenous economic development.
A second member has also decided not to renew his contract, for unspecified reasons.
Corporate adviser Joe Procter has left the National Indigenous Council (NIC) over frustrations
his economic ideas were falling on deaf ears.
"Indigenous economic development was the number one priority identified by the NIC
yet nothing has been taken on board by the government," Mr Procter told The Australian
newspaper.
"Actually it appears to have been ignored by relevant ministers and the government as a whole."
Indigenous Business Australia chairman Joseph Elu also decided not to renew his contract
with the NIC, although his reasons for the decision are unclear, the paper said.
A spokesman for indigenous affairs minister Mal Brough said Mr Procter's decision not
to renew his NIC contract was not a resignation, and defended the government's economic
credentials.
"No one can say that Mal Brough doesn't support economic development," the spokesman said.
"If anything he has been criticised for the speed (with which) he has pushed reforms
like land tenure reforms that underpin economic development."
Mr Brough was forced to apologise to NIC members, after they considered a mass walkout
over concerns they were being marginalised and undervalued.

The New South Wales government will launch a second appeal to try to stop a teacher

payout.
Fifty-three-year-old JEFF SINCLAIR was sacked from his position as head of English

NICKI SHACKLE.
Mr SINCLAIR, who has three children, says the relationship did not become sexual until

Workers Compensation Commission President Justice TERRY SHEAHAN has rejected an appeal

Goha and the Hole from Which Man Emerged
There is a great hole in the Marootzee country out of which men first came, and their footmarks are still to be seen there. One man came out of it long ago, but he went back, and is there yet. The cattle came from the same hole. Matoome was the first man, and had a younger brother of the same name, and a sister whose name was Matoomyane. She was the first who came out from the hole, and had orders respecting the cattle, and was appointed to superintend them. But her brother Matoome came out, and without permission he went and led the cattle around the end of a mountain, which so enraged his sister, who possessed medicine for the preservation of life and death, that she returned to the hole, carrying with her the precious medicine, in consequence of which diseases and death came into the world, and persist to this day. Research Reports on World Wide Web from J. Partyka and Colleagues Provide New Insights.
According to the authors of a study from Richardson, United States, "Resolving semantic heterogeneity across distinct data sources remains a highly relevant problem in the GIS domain requiring innovative solutions. Our approach, called GSim, semantically aligns tables from respective GIS databases by first choosing attributes for comparison."
"We then examine their instances and calculate a similarity value between them called entropy-based distribution (EBD)(1) by combining two separate methods. Our primary method discerns the geographic types from instances of compared attributes. If successful, EBD is calculated using only this method. GSim further facilitates geographic type matching by using latlong values to further disambiguate between multiple types of a given instance and applying attribute weighting to quantify the uniqueness of mapped attributes. If geographic type matching is not possible, we then apply a generic schema matching method, independent of the knowledge domain, which employs normalized Google distance," wrote J. Partyka and colleagues.
The researchers concluded: "We show the effectiveness of our approach over the traditional approaches across multi-jurisdictional datasets by generating impressive results."
Partyka and colleagues published the results of their research in the Journal of Web Semantics (Enhanced geographically typed semantic schema matching. Journal of Web Semantics, 2011;9(1):52-70).

TRAVEL SEARCH SITE SKYSCANNER SETS SIGHTS ON SINGAPORE.

(BW)(SKYSCANNER) Travel Search Site Skyscanner Sets Sights on Singapore as Growth Takes off In Asia Pacific
Lifestyle Editors
EDINBURGH, Scotland--(BUSINESS WIRE) - Jun. 26, 2011-- Leading travel search site Skyscanner today announced turnover of GBP 15.2 million - a year on year revenue increase of 75 per cent - for the financial year ending May 31st 2011.
With sessions for the year of 130 million (up 44 per cent), Skyscanner's fast growth trajectory continues, paving the way for plans unveiled today to build on the company's success in Asia and the Pacific Rim by opening a new regional operation based in Singapore in September.
"We're very excited about this move," said Ewan Gray, newly appointed Regional Director for Asia Pacific. "We're seeing exceptionally strong growth in these markets which has largely been organic to date - in countries such as Singapore, China, Indonesia, Japan, India and Malaysia, we're already seeing yearly increases in traffic of up to 90 per cent.
"However, the huge scale of these markets, combined with their sophistication and speed of growth presents a particular set of technical and business challenges and very specific customer requirements.
"While online travel companies find internationalisation tough, we're confident about the scalability of our business model. Skyscanner was designed from the outset to perform well at a global level - building comprehensive flight coverage through direct airline connections, as well as solving language and currency issues."
The fast pace of international expansion accounts for the majority of Skyscanner's growth in the last three years, fuelled by highly profitable core markets and a rapidly expanding network of direct commercial partnerships with airlines, online travel agents and other travel companies throughout the world.
In his former role as Head of Sales at Skyscanner, Gray has played a large part in driving that growth. He continued: "The relationships we have with airlines and OTAs are incredibly important to us and are founded on sending them highly qualified referrals from customers confident they have found the best flight deal available. We're looking forward to providing this region with dedicated support to capitalise on its potential, building our position as one of the world's leading travel search sites."
In addition to Gray, other key appointments for the new Singapore operation have been made, including Yi Bao, formerly a member of the core team at travel start-up Zoombu, acquired by Skyscanner at the end of 2010. Yi Bao is taking up the role of Market Development Manager for China. Recruitment is underway for other key market development roles.

DALLAS MAN SENTENCED TO SEVEN YEARS IN FEDERAL PRISON ON CHILD PORNOGRAPHY CONVICTION.
DALLAS, TX -- The following information was released by the United States Attorney's Office for the Northern District of Texas:
Michael Priesont, 68, of Dallas, was sentenced yesterday by U.S. District Judge David C. Godbey to 84 months in federal prison following his guilty plea in August 2010 to an information charging one count of receipt of child pornography, announced U.S. Attorney James T. Jacks of the Northern District of Texas. In addition, Judge Godbey ordered that Priesont serve a lifetime of supervised release following his incarceration.
According to documents filed in the case, on May 14, 2010, FBI agents executed a search warrant at Priesont's residence in Dallas, that resulted in the identification of between 150 and 300 images of child pornography in his possession. The images were found on his laptop computer that was seized from the trunk of his car. Priesont admitted using file-sharing software for at approximately two years to download child pornography onto his laptop computer. He also admitted that some of the images depicted prepubescent minors engaged in sexual acts, and some portrayed sadistic and/or masochistic conduct.
This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice. Led by United States Attorneys' Offices and the Criminal Division's Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state and
local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims. For more information about Project Safe Childhood, please visit www.projectsafechildhood.gov
The case was investigated by the FBI and prosecuted by Assistant U.S. Attorney Lisa J. Miller.

Research from University of Grenoble Has Provided New Data on Astrophysics.
According to recent research from Grenoble, France, "The advent of large instantaneous bandwidth receivers and high spectral resolution spectrometers on (sub-)millimeter telescopes has opened up the possibilities for unbiased spectral surveys. Because of the large amount of data they contain, any analysis of these surveys requires dedicated software tools."
"Here we present an extension of the widely used CLASS software that we developed to that purpose. This extension, named Weeds, allows for searches in atomic and molecular lines databases (e.g. JPL or CDMS) that may be accessed over the internet using a virtual observatory (VO) compliant protocol. The package permits a quick navigation across a spectral survey to search for lines of a given species. Weeds is also capable of modeling a spectrum, as often needed for line identification," wrote S. Maret and colleagues, University of Grenoble.
The researchers concluded: "We expect that Weeds will be useful for analyzing and interpreting the spectral surveys that will be done with the HIFI instrument onboard Herschel, but also observations carried-out with ground based millimeter and sub-millimeter telescopes and interferometers, such as IRAM-30 m and Plateau de Bure, CARMA, SMA, eVLA, and ALMA."
Maret and colleagues published their study in Astronomy & Astrophysics (Weeds: a CLASS extension for the analysis of millimeter and sub-millimeter spectral surveys. Astronomy & Astrophysics, 2011;526():A47).

Hamilton Relay Selected New Provider of Captioned Telephone Services in Virginia.
Hamilton Relay Now Providing Captioned Telephone Services in 19 States and the District of Columbia
AURORA, Neb., April 12, 2011 /PRNewswire/ -- Hamilton Relay announced today that they have been selected by the Virginia Department for the Deaf and Hard of Hearing (VDDHH) to provide Captioned Telephone (CapTel) services in the Commonwealth of Virginia. The service makes it possible for individuals who are deaf or hard of hearing to make and receive telephone calls using captioned telephone technology, ensuring call clarity for both parties. Hamilton began providing Captioned Telephone Service in Virginia on April 1, 2011.
Captioned Telephone is similar to closed captioning on television, in that it allows users to "see what they say" by reading captions of their telephone conversations through the use of a CapTel phone. Behind the scenes, specially trained operators at the Captioning Center use advanced voice recognition technology to convert everything that's said by the standard phone user into captions that appear on the large, bright display screen built in to the CapTel phone. Residents of the Commonwealth of Virginia can purchase a CapTel phone or qualify to obtain one at no cost through VDDHH. Captions are available in both English and Spanish.
"We are thrilled to provide this service to the residents of Virginia who may benefit from Hamilton's Captioned Telephone service," said Dixie Ziegler, vice president of Hamilton Relay. "Hamilton CapTel allows for smoother telephone communication between individuals who are hard of hearing and those who are hearing. The service can make an incredible difference in the relationships between CapTel users and their family, business associates, and friends. We want to make sure that no Virginian misses a word of what is being said on the telephone."

THE FBI NEW YORK OFFICE WARNS AGAINST HAITIAN EARTHQUAKE FRAUD.
NEW YORK, NY -- The following information was released by the New York Division of the Federal Bureau of Investigation:
The FBI New York Office reminds the public to apply a critical eye before giving contributions to anyone soliciting donations on behalf of Haitian victims. In the past, tragedies and natural disasters have inspired individuals with criminal intent to solicit contribution while falsely representing a charitable organization and/or good cause.
Therefore, before making a donation of any kind, consumers should adhere to certain guidelines, including the following:
Do not respond to any unsolicited (spam) incoming e-mails, including clicking links contained within those messages.
Be skeptical of individuals representing themselves as surviving victims or officials asking for donations via e-mail or social networking sites.
Beware of organizations with copy-cat names similar to but not exactly the same as those of reputable charities.
Rather than following a purported link to a website, verify the legitimacy of non-profit organizations by utilizing various Internet-based resources that may assist in confirming the group's existence and its non-profit status.
Be cautious of e-mails that claim to show pictures of the disaster areas in attached files, because the files may contain viruses. Only open attachments from known senders.
To ensure contributions are received and used for intended purposes, make contributions directly to known organizations rather than relying on others to make the donation on your behalf.
Do not be pressured into making contributions, as reputable charities do not use such tactics.
Do not give your personal or financial information to anyone who solicits contributions. Providing such information may compromise your identity and make you vulnerable to identity theft.
Avoid cash donations if possible. Pay by debit or credit card, or write a check directly to the charity. Do not make checks payable to individuals
Special Agent Richard Kolko, spokesman for the FBI in New York said, "Every time there is a major tragedy, such as the recent earthquake in Haiti, those that intend to take advantage of people's generosity come out of the woodwork with all types of scams to steal your money and deny it from those that need it most. The New York area has a large Haitian population and this event has hit close to home. We encourage people to donate, but make sure you know who you are donating to and where the money is going. It is vital for everyone to do their due diligence in researching the charitable organization they are contributing to, so that you can be sure your donations are reaching the hands of those who are truly in need of assistance."
If you believe you have been a victim of fraud from a person or an organization soliciting relief funds on behalf of Haitian earthquake victims, contact the National Center for Disaster Fraud at (866) 720-5721. You can also fax information to (225) 334-4707 or e-mail it to disaster@leo.gov.
You can also report suspicious e-mail solicitations or fraudulent websites to the FBI's Internet Crime Complaint Center at http://www.ic3.gov.
Taking out a contract on workplace romance: 'Love contract' can protect employees and the company from discrimination claims.(THE LAW)
Q. Janet in HR learns that two supervisors are in a consensual romantic relationship. Each supervisor heads a separate department, but they both attend supervisor meetings and functions together. The company has an anti-harassment, sexual harassment and retaliation policy that each has signed. The company provides yearly training on its policies to its supervisors and employees. Janet is concerned about protecting the company from possible litigation should the relationship end. She also wants to make sure the relationship does not affect their conduct in the workplace. What are the company's options?
A. Workplace romances can be common, given the amount of time people spend at their jobs. But as Neil Sedaka once voiced, breaking up is hard to do. Sexual harassment and retaliation claims may arise after a consensual relationship ends or goes sour.
From a survey conducted in 2008 by Vault.com, 46 percent admitted to having an office romance. Another 13 percent said that they would be willing to have an office romance if the opportunity arose. Twenty percent admitted to meeting their spouse or long-term significant other on the job. Indeed, a search of the Internet offers an array of "how to" guides on dating in the workplace.
When it comes to office romance, some companies choose to have no policy and to rely on their anti-harassment and retaliation policies and training programs already in place. Other companies handle workplace romance by having a written anti-fraternization policy that prohibits dating all together or prohibits dating between supervisors and subordinates.
More recently, companies are considering voluntary relationship contracts, also called "love contracts." While contracts between two individuals may be seen as unromantic, employers see them as a way of protecting both the individuals involved and the company from discrimination claims.
While it may not prevent all litigation, a "love contract" will assist the company in defending claims. It is a document signed by the individuals involved and the company that affirms the voluntary and consensual nature of the relationship and reiterates and acknowledges the company's anti-harassment and retaliation policies. It affirms that neither person has been forced, harassed or threatened into the relationship. It also establishes appropriate and professional office behavior during the relationship and after if it ends.
A love contract is not perfect. It requires a policy of reporting to HR the consensual relationship. It also requires reporting to HR when the relationship ends. Employers also need to be careful about favoritism claims by other co-workers.
New Hampshire courts have not ruled on the enforceability of a love contract. The value of the document, however, is the employees' acknowledgement. The love contract serves as powerful evidence that the relationship was consensual, that the employees were aware of the company's sexual harassment and retaliation policies and agreed to report any harassment or retaliation if the relationship ends, and that the company took steps to maintain a workplace free from sexual harassment and retaliation.
When presenting such a contract, it is important to meet separately with each individual involved. Both individuals should sign and commit to the love contract. Depending on the circumstances, some of the following provisions may be appropriate:
* Both individuals confirm the relationship has been and continues to be consensual and voluntary.
* The company's sexual harassment, retaliation and other applicable policies are reiterated and acknowledged. This may include a restatement of the company's zero tolerance policy of harassment and discrimination.
* Both individuals agree to act professionally at work and to not conduct any public displays of affection or other inappropriate personal contact while at work or at work functions.
* Both individuals will refrain from favoritism and conflicts of interest.
* Both individuals agree not to use company property inappropriately or contrary to the company's policy, including, but not limited to, its computers, e-mail, voice mail, cell phones or other devices.
* Both individuals acknowledge the company may monitor its property at any time.
* Both individuals agree to report any harassing conduct if the relationship ends.
* Both individuals agree to treat each
other with respect if the relationship ends.
* Both individuals agree not to retaliate if the relationship ends at either individual's decision.
* Both individuals agree to notify HR if the relationship ends.
* Each individual acknowledges sufficient time to consider fully and understand the love contract and each may want to consult with an attorney before signing.
Love contracts are not appropriate in every circumstance, and they should only be used in suitable situations. A company interested in developing a love contract should consult with counsel. Any policy should apply to and be enforced uniformly among employees, regardless of marital status, gender and sexual orientation as well as other legally protected categories.
Whatever an employer decides on this issue, there is no substitute for training managers and supervisors on the risks of romantic involvement with employees. Companies should have anti-harassment, retaliation and discrimination policies in place and disseminated companywide.
